Terms and Conditions – Better My English
1. Introduction
These Terms and Conditions (“Terms”) outline the agreement between Better My English (“we”, “us”, or “our”) and you (“the student”, “you”, or “your”). By booking or attending an online lesson with Better My English, you confirm that you have read, understood, and agreed to these Terms.
Better My English is a business operated by a sole trader registered in Australia, providing online English tutoring services to adult learners, including IELTS preparation and general English improvement.
2. Lessons and Eligibility
All lessons are delivered online only via an agreed video platform (such as Zoom, Google Meet, or Microsoft Teams). Better My English provides private English tutoring focused on helping students develop fluency, accuracy, and confidence in the English language.
You must be 18 years of age or older to enrol in lessons. Lessons are intended for individual learning purposes only and are not accredited courses or formal qualifications.
3. Bookings and Payment
Lessons are charged per session. Payment must be made in full before the lesson to secure your booking.
Cancellations and Rescheduling: You may cancel or reschedule a session by providing at least 24 hours’ notice before the scheduled start time. Requests made with less than 24 hours’ notice, or failure to attend a booked session, will result in the session being forfeited with no refund or credit.
Refunds: Payments are non-refundable once a booking is confirmed. Exceptions apply only if Better My English cancels a session and no reschedule is possible.
Tutor Cancellations: If we must cancel or postpone a lesson due to illness, emergency, or technical issues, we will contact you as soon as possible and arrange a reschedule or refund for that session.
All bookings are subject to tutor availability.
4. Student Conduct
You are expected to behave respectfully and professionally during all lessons. Disruptive, offensive, or inappropriate conduct (including abusive language or harassment) will not be tolerated. Better My English reserves the right to terminate a lesson immediately or end ongoing tutoring arrangements if a student engages in inappropriate conduct. No refund will be provided in such cases.
5. Learning Outcomes and IELTS Disclaimer
Better My English provides guidance and support to help you improve your English proficiency and prepare effectively for exams such as IELTS.
However, we do not guarantee any specific test scores, band results, or outcomes. Your progress and exam performance depend on multiple factors beyond our control — including your starting skill level, personal effort, study consistency, and application of feedback.
While we aim to support your learning, you acknowledge that final results are your own responsibility.
6. Lesson Materials and Intellectual Property
All resources, handouts, slides, and other materials provided during lessons are the intellectual property of Better My English.
You are granted permission to use these materials only for your personal study during your enrolment period. They may not be copied, shared, recorded, distributed, or reused without written consent.
Unauthorized recording of lessons (audio or video) is prohibited. Likewise, we will not record lessons without your consent. These conditions remain in effect even after your lessons have ended.
7. Privacy and Data Handling
Better My English collects and stores only the minimum personal information required to provide tutoring services — specifically your name, email address, and phone number.
This information is used solely for communication, scheduling, and lesson administration. We do not collect academic progress data, assessment results, or sensitive personal information.
Your details are kept confidential and will not be sold, shared, or used for marketing purposes. Data is stored securely and deleted upon request, except where retention is required by Australian tax or recordkeeping laws.
By booking lessons, you consent to the collection and use of your contact details for communication related to tutoring services.
8. Limitation of Liability
While we strive to provide lessons with care and professionalism, Better My English is not liable for any loss, damage, or dissatisfaction arising from the tutoring services provided.
This includes, but is not limited to: failure to achieve a particular test result or academic goal, disruption caused by internet or software issues, or loss of data or materials during online sessions.
Our total liability, if any, will not exceed the amount paid for the affected lesson. Nothing in these Terms limits any rights you may have under the Australian Consumer Law.
9. Updates to Terms
Better My English may amend these Terms occasionally to reflect updates in our policies or legal requirements. When changes occur, the updated version will be published on our website. Continued use of our services after such updates constitutes acceptance of the revised Terms.
10. Governing Law
These Terms are governed by the laws of South Australia, Australia. Any disputes will be handled under the jurisdiction of South Australian courts.
